1. Agreement to Terms
By accessing or using Arleik (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including creators who receive tips and fans who send tips.
2. Description of Service
Arleik is a technology platform that enables fans to send one-time tips to creators through a shareable link. Creators can sign up, create a profile, and receive a personalized support link to place in their social media bios. Fans can tip creators by paying via UPI through the creator's support page. The Platform generates UPI payment links and QR codes — the actual payment is a peer-to-peer UPI transaction between the fan and the creator.
The Platform acts only as a technology provider. It does not process, hold, or intermediate payments. It does not act as a bank, payment aggregator, or financial institution, and does not guarantee any income, rewards, or outcomes related to tips. UPI transactions occur directly between the fan's and creator's UPI-linked bank accounts.
3. Eligibility
To receive payments on the Platform, you must be at least 18 years old and capable of entering into a legally binding agreement under Indian law. Creators under the age of 18 may only use the Platform through a verified parent or legal guardian account, where all payments are received and managed by the guardian. This is required to comply with payment regulations and contract laws.
By creating an account, you represent that you meet these eligibility requirements and that the information you provide is accurate and complete.
4. Creator Accounts
To receive tips, you must create a creator account, provide your UPI ID, and set up your support page. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration and to update your information as needed. We reserve the right to suspend or terminate accounts with inaccurate or incomplete information.
5. Payments and Fees
Arleik is a technology platform only — it does not process, hold, or intermediate any payments. Tips are peer-to-peer UPI transactions that occur directly between the fan's UPI app and the creator's UPI ID. The Platform merely generates UPI deep links and QR codes to facilitate these transactions.
Arleik is currently free to use. There are no platform fees, service fees, or hidden charges. Creators are responsible for tax compliance (including GST registration if applicable and income tax) on tips received. UPI transaction failures or disputes are between the user and their UPI service provider or bank.
If Arleik introduces fees in the future, users will be notified at least 30 days in advance via email and/or an in-app notification before any changes take effect.
5A. Tax Responsibilities
As a creator receiving tips through the Platform:
- You are responsible for reporting all tips received as income under applicable Indian tax laws, including the Income Tax Act, 1961.
- Tips or gifts exceeding ₹50,000 in aggregate during a financial year may attract tax under Section 56(2)(x) of the Income Tax Act and may have TDS implications. Consult a tax professional for your specific situation.
- Arleik does not provide tax documentation (such as Form 16A or TDS certificates) as it does not process payments.
- GST: Arleik currently provides a free service. If GST becomes applicable to the Platform's services, users will be notified in advance.
- Creators are advised to maintain their own records of tips received and consult a qualified tax professional.
6. Creator Responsibilities
As a creator on the Platform, you are responsible for:
- The content you publish on your support page
- Any promises you make to supporters regarding rewards or services
- Complying with applicable tax laws and reporting requirements in India — all funds received through UPI are considered your income
- Maintaining accurate and up-to-date account and UPI information
- Using the Platform in accordance with these Terms and all applicable laws
7. Fan Responsibilities
Fans who send tips through the Platform acknowledge that tips are voluntary and are intended as support or appreciation for the creator. Fans are responsible for ensuring they have the authority to use the UPI payment method selected and that all information provided during the transaction is accurate.
8. Refunds and Disputes
Since tips are voluntary, peer-to-peer UPI transactions, they are generally non-refundable. UPI payments follow the Reserve Bank of India's (RBI) UPI dispute resolution framework as administered by the National Payments Corporation of India (NPCI).
Arleik cannot reverse or refund UPI transactions as they are peer-to-peer transfers not under our control. For failed UPI transactions, fans should contact their bank or UPI service provider (e.g., Google Pay, PhonePe, Paytm) directly.
Arleik will cooperate with law enforcement authorities if fraud is reported in connection with transactions facilitated through the Platform. We are not responsible for resolving disputes between fans and creators regarding promises, rewards, or services offered outside the scope of the Platform.
9. Prohibited Conduct
You may not use the Platform for any of the following:
- Fraudulent campaigns or deceptive fundraising
- Misleading or deceptive content designed to manipulate supporters
- Illegal activities or the promotion of illegal activities
- Hate speech, harassment, threats, or discrimination
- Adult, obscene, or restricted content
- Impersonating another person or entity
- Attempting to circumvent our fee structure or payment systems
- Using bots, scripts, or automated tools to interact with the Platform
- Money laundering or terrorist financing
- Any activity that violates applicable laws or regulations
Accounts found violating these rules may be suspended or permanently removed at our discretion.
10. Intellectual Property
The Platform, including its design, logos, text, graphics, and software, is the property of Arleik and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Platform without our express written permission.
Creators retain full ownership of the content they upload to their support pages. By using the Platform, you grant us a limited, non-exclusive license to display your content as necessary to operate the service.
11. Limitation of Liability
To the fullest extent permitted by law, Arleik and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of income, data, or business opportunities.
Our total liability for any claim arising from or related to these Terms shall not exceed the amount of fees we collected from you in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.
13. Account Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may also delete your account at any time through your account settings. Upon termination, your profile and associated data will be handled in accordance with our Privacy Policy.
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the “Last updated” date. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
